Welcome to M Health. These Terms and Conditions ("Terms") govern your access to and use of the M Health website (mworldhealth.com), our mobile applications (if any), and all services provided by M Health at our facility located at 2609 Technology Dr, Plano, TX 75074 (collectively, the "Services"). By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or Services.

1. About M Health

M Health is an integrated wellness facility offering medical aesthetics, IV therapy, clinical wellness services, bodywork and recovery services, and performance training under physician oversight. M Health operates as a medical practice in the State of Texas under the supervision of a licensed Medical Director. All medical services are provided by or under the supervision of licensed healthcare professionals in accordance with Texas medical practice laws.

2. Not Emergency Medical Care

M Health provides wellness, aesthetic, and preventive health services. Our Services are not a substitute for emergency medical care, primary care physician services, or hospital-based treatment. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately. M Health does not provide emergency medical services, and our facility is not equipped to handle medical emergencies beyond basic first aid and stabilization.

3. Eligibility

You must be at least 18 years of age to use our website independently and to consent to medical services. Certain non-medical wellness and bodywork services (such as athletic rehabilitation) may be provided to individuals under 18 with written consent from a parent or legal guardian who must be present during the initial consultation. Specific age requirements may apply to individual services and will be communicated during the booking or consultation process.

4. Account Registration

Certain features of our website and Services, including online booking and membership management, may require you to create an account through our booking platform, Boulevard. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update your information promptly if it changes. You agree to notify us immediately at (469) 391-8999 if you suspect unauthorized access to your account.

5. Appointments and Scheduling

5.1 Booking

Appointments may be scheduled online through our website, by phone at (469) 391-8999, by text message, or in person at our facility. Booking an appointment constitutes your agreement to these Terms and to the specific informed consent requirements of the services you have selected.

5.2 Cancellation Policy

We respectfully require at least 24 hours' advance notice for cancellations or rescheduling. Late cancellations (less than 24 hours' notice) and no-shows may be subject to a cancellation fee of up to the full cost of the scheduled service, at M Health's discretion. Repeated late cancellations or no-shows may result in a requirement to prepay for future appointments. We understand that emergencies happen, and we will consider individual circumstances on a case-by-case basis.

5.3 Timeliness

Please arrive on time for your scheduled appointment. If you arrive more than 15 minutes late, we may need to reschedule your appointment to ensure adequate time for your treatment and to avoid delays for other patients. Late arrivals may result in a shortened treatment session at the full appointment price.

6. Informed Consent

All medical and aesthetic services at M Health require informed consent prior to treatment. Before receiving any medical service, you will be provided with information about the proposed treatment, its expected benefits, potential risks and side effects, alternative treatment options, and the consequences of declining treatment. You will be asked to sign a written consent form acknowledging that you have received this information and that you voluntarily consent to the proposed treatment.

By consenting to treatment, you acknowledge that:

  • No guarantee of specific results has been made. Individual outcomes vary based on factors including your health, anatomy, lifestyle, and adherence to post-treatment instructions.
  • You have disclosed your complete and accurate health history, including all medications, supplements, allergies, medical conditions, and prior treatments.
  • You will follow all pre-treatment and post-treatment instructions provided by your M Health provider.
  • You understand the potential risks and complications associated with your chosen treatment.

7. Photographs and Imaging

M Health may take photographs or video recordings before, during, or after treatment for the following purposes:

  • Medical Records: Clinical documentation of your treatment and results for your medical file.
  • Treatment Planning: Visual assessment and comparison to guide treatment decisions.
  • Marketing and Education: With your separate, explicit written consent, de-identified photographs may be used on our website, social media, or marketing materials. You may decline or revoke marketing consent at any time without affecting your treatment.

All clinical photographs are considered part of your medical record and are handled in accordance with HIPAA regulations. Marketing consent is separate from treatment consent, and you are never required to consent to marketing use of your photographs as a condition of receiving services.

8. Payment and Financial Responsibility

8.1 Payment Terms

Payment for services is due at the time of service unless otherwise arranged in advance. We accept major credit cards, debit cards, HSA/FSA cards (for eligible services), and cash. Prices for services are available on our website and at our facility and are subject to change without prior notice. The price in effect at the time of your appointment applies.

8.2 Insurance

Most wellness, aesthetic, and elective services provided by M Health are not covered by health insurance. Certain diagnostic laboratory services may be eligible for insurance coverage when medically indicated. M Health will provide you with the documentation necessary to submit claims to your insurance provider, but we do not guarantee insurance coverage or reimbursement. You are responsible for payment regardless of insurance status.

8.3 Memberships

M Health membership plans are billed on a monthly recurring basis. Membership terms, including pricing, included services, and cancellation policies, are governed by a separate Membership Agreement provided at the time of enrollment. Membership fees are non-refundable for the current billing period. Members may cancel their membership in accordance with the terms of their Membership Agreement.

8.4 Refunds

Due to the nature of medical and wellness services, refunds are generally not available for services that have been rendered. If you are dissatisfied with a service, please contact us within 14 days so we can discuss your concerns and explore options, which may include complimentary follow-up treatments or adjustments. Product purchases may be returned within 14 days in unopened, unused condition with original receipt for a full refund or exchange.

9. Assumption of Risk

By receiving services at M Health, you acknowledge that all medical, aesthetic, and wellness treatments carry inherent risks, including but not limited to: bruising, swelling, redness, infection, allergic reaction, unsatisfactory results, and in rare cases, more serious complications. While our providers take every precaution to minimize risks and deliver safe, high-quality care, no medical or aesthetic procedure is entirely risk-free.

For non-medical services such as bodywork, fascial stretch therapy, and massage, you acknowledge that physical manipulation of the body may occasionally result in temporary soreness, bruising, or discomfort. You agree to communicate with your provider during treatment if you experience pain or discomfort beyond your tolerance.

10. Limitation of Liability

To the fullest extent permitted by applicable law, M Health, its owners, officers, employees, providers, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our website or Services, including but not limited to loss of profits, data, goodwill, or other intangible losses.

Our total aggregate liability for any claim arising from or related to these Terms or our Services shall not exceed the total amount you paid to M Health for the specific service giving rise to the claim during the twelve (12) months preceding the event that gave rise to the liability.

Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by gross negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be limited or excluded by applicable law.

11. Intellectual Property

All content on the M Health website, including but not limited to text, graphics, logos, images, photographs, videos, software, and the overall design and layout of the website, is the property of M Health or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our website without our prior written permission. You may print or download content from our website for your own personal, non-commercial use, provided you retain all copyright and proprietary notices.

The M Health name, logo, and all related marks are trademarks of M Health. You may not use these marks without our prior written permission.

12. User Conduct

When using our website or visiting our facility, you agree not to:

  • Provide false, inaccurate, or misleading information.
  • Attempt to access restricted areas of our website, servers, or systems.
  • Use automated tools (bots, scrapers, crawlers) to access or collect data from our website without our written permission.
  • Interfere with or disrupt the operation of our website or Services.
  • Engage in abusive, threatening, or disrespectful behavior toward M Health staff, providers, or other patients.
  • Record, photograph, or film other patients, staff, or treatment areas of our facility without explicit consent.

M Health reserves the right to refuse service, terminate accounts, and restrict access to our facility for violations of these Terms or for conduct that we determine, in our sole discretion, to be harmful, disruptive, or unsafe.

13. Indemnification

You agree to indemnify, defend, and hold harmless M Health, its owners, officers, employees, providers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your violation of these Terms; (b) your use of our Services; (c) your provision of inaccurate or incomplete health information; or (d) your violation of any applicable law or the rights of any third party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws provisions. Any dispute arising from or related to these Terms or our Services shall be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of such courts.

Before initiating any legal proceeding, you agree to first attempt to resolve any dispute with M Health through informal negotiation by contacting us at (469) 391-8999 or legal@mworldhealth.com. If informal resolution is not achieved within thirty (30) days, either party may pursue formal remedies.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

16. Entire Agreement

These Terms, together with our Privacy Policy, HIPAA Notice of Privacy Practices, and any applicable Membership Agreement or informed consent forms, constitute the entire agreement between you and M Health regarding your use of our website and Services. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, regarding the subject matter herein.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our website or Services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
